These Terms and Conditions of Use and the Privacy Policy regulate the use of the website

www.arboraverd.com of which Albert Salvadó Cot is the owner. The use by the client of the services of the ÀRBORA internet store presupposes, in any case, adherence to the Terms and Conditions of Use in the version published by ÀRBORA on this website. Therefore, it is convenient for the customer to read these Terms and Conditions before proceeding to make a purchase.

SCOPE OF THE CONTRACT

These Terms and Conditions of Use apply to the sale of all ÀRBORA items through its purchase website, www.arboraverd.com , to consumers to whom orders can be delivered. ÀRBORA informs that the website is directed exclusively to a public over 18 years of age. ÀRBORA reserves the right to cancel a user's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

PRICES

The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each item and include VAT (Value Added Tax). The amount of the shipping costs is indicated to the customer in a detailed manner at the time the order is placed. ÀRBORA reserves the right to make, at any time and without prior notice, the modifications it deems appropriate, being able to update, even daily, articles and prices depending on the new features that appear.

PAYMENT

All purchases can be paid by credit / debit card, bank transfer or PayPal System. You must notify ÀRBORA of any improper or fraudulent charge to your bank account, by email or by telephone, in the shortest possible time so that ÀRBORA can take the necessary steps. Additionally, financial institutions or the PayPal system can adopt anti-fraud measures that lead to the rejection of certain types of operations. ÀRBORA is not responsible for the application of this type of security policies.

Due to the exceptional situation caused by the Coronavirus and to guarantee the correct delivery of the products, we only ship orders through SEUR with the following rates:

 

Peninsular Spain

Next day shipping: 14 euros

Shipping in 2 - 3 business days: 8 euros

 

Balearic Islands

Next day shipping: 22 euros

 

Canary Islands (provide the recipient's ID)

Next day shipping: 28 euros

Shipping in 3 business days: 19 euros

We ship throughout Europe and Spain (For shipments to the Canary Islands, you must provide the customer's ID). The delivery will be made to the address indicated by the client, which may be different from that of his habitual residence, being able to send to his place of work or even to a third person to whom you want to make a gift. In any of the cases, the identification of the buyer or the person to whom the article is addressed will be required, by means of an official document that identifies him and signature of the delivery note. The delivery period set on the page will be purely indicative. However, ÀRBORA, will endeavor to respect this period, not being responsible in case of exceeding the initially estimated period. We send the packages through the Correos service and in a certified way (we provide a tracking number), at most 48 hours after receiving the payment.

Shipping charges include packaging, handling and shipping. They can contain a fixed part and a variable part based on the price and weight of your purchase. We recommend that you consolidate your purchases in a single order since we cannot group two different orders and you have to pay shipping costs for each one.

We calculate the approximate weight of your order, and based on it, we apply shipping costs. It is informed of the shipping costs applied at the time of proceeding with the review and payment of the order.

We also have express shipping available with next business day delivery, by Express Mail. Check prices at the time of ordering.

It is possible to collect the order in person and at no cost at the following address: Passeig Verdum 13, 08197 - Sant Cugat del Vallès (Barcelona) . In this case, we will contact the client to determine a pick up time and day.

RETURNS & EXCHANGES

Due to the perishable nature of the plants and the damages they may suffer due to temperature variations or exposure to adverse circumstances to their conservation during the distribution process, something for which ÀRBORA is not responsible, we will not make changes or product returns , except in cases where there has been a lack of correspondence between the product chosen by the client and the one sent by ÀRBORA. The exception to the customer's right of withdrawal with respect to perishable goods is included in art. 103 d) of the Consolidated Text of the Law for the Defense of Consumers and Users.

The items to be returned must be in their original packaging in the same conditions in which they were sent.

RETURN PROCESS FOR ERROR IN PRODUCT SHIPPING

The return process must start within 14 working days after receiving the order, sending reliable notification of the error to the registered office of ÀRBORA.

Cost: In the event that the products must be finally returned, the returns for error in the shipment of the product, have no cost to the customer.

ÀRBORA, at its decision, will refund the customer with the product initially ordered or pay the amount corresponding to the price paid within 30 calendar days from receipt of the notification. The return will be made by the same means of payment with which it was paid.

AVAILABILITY AND STOCK

All orders are subject to availability of the chosen products. In the event of any difficulty in supply or if the products are out of stock, the customer will be informed immediately and any amount they have already paid will be returned to them.

GUARANTEE OF THE ITEMS PURCHASED

ÀRBORA will respond for the lack of conformity because the product sent was not the one chosen by the client, which manifests itself within five working days from delivery. The exception of the guarantee period established by the Consolidated Text of the Law of Defense of Consumers and Users for perishable products is included in art. 126 of the mentioned legal body.

ÀRBORA will attend to your request as soon as possible and, in any case, within a month. In the event that your request is not satisfactorily resolved, you will be able to access the judicial conflict resolution system indicated below.

DATA PROTECTION

In accordance with the Organic Law on Data Protection 15/1999 of December 13, Protection of Personal Data, all personal data that has been provided voluntarily will be included in a company file for the purpose of managing and deliver the order placed, as well as to send commercial information about ÀRBORA. We can contact the client by any electronic means. The client can exercise his right to access, rectify, cancel and oppose this information at the email address arbora.verd@gmail.com. The responsibility for this file corresponds to ÀRBORA.

APPLICABLE LAW AND JURISDICTION

These General Conditions of Purchase are subject to Spanish law. The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts of Barcelona.
